Hajj-e-Badal / Substitute Hajj
Hajj-e-Badal signifies the performance of Hajj on behalf of someone else, There is no condition to perform a substitute Hajj or Umrah on behalf any other person except that one performing this substitute Hajj should be perfectly capable of doing all the rites. However to depute someone else to perform Hajj on one’s own behalf, there are certain conditions:
- Hajj has fallen due on the proposer.
- One has become incapacitative soon after the Hajj has become due to him and there is no hope of restoration of normal health.
- Both, the one being deputed (Mamoor) and the one who deputes (Aamir) are Muslim and sensible.
- One who is being deputed for Hajj-e-Badal (substitute) should be able to understand all the rites of Hajj. It is preferable to depute some one who has already performed Hajj and know all the rites.
- For Hajj-e-Badal one should order the substitute himself. If he dies leaving a will, then the heir or successor should himself order the substitute for Hajj-e-Badal. Even if one dies without notifying for Hajj-e-Badal in his will but the heir or successor arranges an Hajj-e-Badal for him, the reward shall reach to him.
- Aamir should bear all expenses of Hajj-e-Badal. However if Mamoor performed Hajj from his own money and then realised all expenses from Aamir, the reward of Hajj shall be bestowed to Aamir.
- One who is to perform Hajj on behalf some one else, shall have to express the intention (Niyat) on behalf of Aamir at the time of donning the Ihram.
- Mamoor shall don Ihram on behalf of only one person.
- If an Aamir has nominated a certain person for Hajj-e-Badal his replacement shall be wrong unless Manmoor refuse to do so.
- If one third amount out of inheritance is sufficient for the entire expenses of Hajj-e-Badal then Mamoor should perform Hajj on expenses from the hometown of Aamir. Otherwise expenses from Meeqat onward should be paid to Mamoor.
- If Mamoor donned Ihram at Meeqat for Umrah only and then while in Makkah donned Ihram for Hajj and performed Hajj, it will not be Hajj-e-Badal on behalf of Aamir. This clarifies that deputing for Hajj-e-Badal from among those living in Makkah or Madina is not correct. The benefit of such Hajj shall go Mamoor and not to Aamir who ordered the Hajj-e-Badal to some one residing in Makkah or Madina.
- Mamoor shall have to observe the category of Hajj-e-Badal as desired by his Aamir. If Aamir has ordered Hajj-e-Ifrad but Mamoor observed and performed Hajj-e-Tamattu or Qiran, it will be disobedience. The benefit of this performance shall go to Mamoor and he will have to refund all expenses paid by Aamir to him.
- Hajj-e-Badal should be performed only by one who has performed his own Hajj. However, Imam Abu Hanifa differs and according to him Hajj-e-Badal can equally be performed by one who has not yet performed his own Hajj.
